DIVORCE PROCEDURES

As set forth in the Family Law Issues section, this firm will make every effort to resolve each and every issue by way of Collaborative Family Law Resolution.  All efforts towards this end will yield dividends for any issue or issues that must be resolved via litigation.

Notwithstanding, there are basically four procedural steps in achieving a Dissolution of Marriage or Domestic Partnership (Divorce) and/or Legal Separation:

1. PLEADING STAGE- Each party files a pleading.  The first to file is known as the Petitioner who then has the pleading documents served on the other party.  The other party then files and serves what is known as a Response and he is referred to as the Respondent;

2. DECLARATION STAGE- Each party is required to provide the other with certain information regarding their assets, debts, income and expenses.

3. DISCOVERY STAGE- If a party or their attorney feels they need more information, they will request or demand information, testimony and/or documents in order to be fully informed of relevant information.  This is also a useful time to retain the services of a joint accountant and/or joint mental health professional to help resolve related remaining issues.

4. SETTLEMENT OR TRIAL STAGE- At this stage the attorneys either negotiate a settlement and prepare and submit a Marital Settlement Agreement or Stipulated Judgment on all issues, or, the remaining issues are set for Trial.
